It reflects legal changes
The Conveyancing Association (CA) has published the sixth edition of its Conveyancing Technical Protocol, a key resource designed to standardise best practices in the conveyancing sector.
Originally introduced in 2013, the Technical Protocol is the result of collaboration between CA members, panel management companies, and other industry stakeholders. It consolidates guidance from the Law Society, Legal Ombudsman, UK Finance, and relevant case law to offer conveyancers a comprehensive reference for handling transactions efficiently and professionally.
The latest update incorporates changes stemming from recent legislation, including amendments from the Building Safety Act. Specifically, it reflects the extension of enforcement periods for planning and building regulations in England. Enforcement timelines now extend to 10 years for planning issues, compared to the previous four years, while building regulations are enforceable for 12 months. In Wales, however, the enforcement period for planning remains at four years.
The updated protocol also adds recommendations for conveyancers to promote the use of gas safety certificates and electrical test reports, enhancing safety in transactions involving property alterations and extensions.
Conveyancing firms can access the new Technical Protocol, along with the Digital Conveyancing Protocol, via The Conveyancing Association website.
“Our last update to the Technical Protocol took place almost two years ago when we provided a number of updates regarding digital developments and how conveyancing firms could make the most of these efficiency-benefiting opportunities,” said Beth Rudolf (pictured), director of delivery at The Conveyancing Association. “We wanted to ensure the Building Safety Act amendments to both Planning Permission and Building Regulations, specifically within England, were included in the Protocol as soon as possible.
“We continue to commend the adoption of this, and our other protocols and guidance to our membership as an opportunity to improve client satisfaction, while reducing enquiries and administrative workload. We remain committed to reviewing our protocols regularly to ensure they are up to date and would urge all firms to download and integrate this latest version into their businesses.”
