The suit alleges over 1,000 mobile mortgage specialists did not receive proper vacation pay
A proposed class action lawsuit against TD Bank alleges that the company did not pay more than 1,000 mobile mortgage specialists their proper vacation and holiday pay, The Canadian Press has reported.
According to the allegations, which have yet to be tested or proven in court, mobile mortgage specialists at the bank were not paid or properly paid vacation and/or public holiday pay on volume bonuses, commissions and other variable payments.
That money was owed but not paid, the case alleges, on top of set commissions and other compensation not included in salary.
The proposed representative plaintiff for the case, while was filed in the Ontario Superior Court of Justice, is Jason Chiang, a former 13-year employee of TD in Vancouver.
TD did not immediately respond to The Canadian Press’s requests for comments, although lawyers for the plaintiff indicated they expected the bank to defend the case and deny the allegations.
